By accessing or using the website located at rialtoconcrete.com (the "Site"), or by requesting services from TotalForm Rialto Concrete Masters ("we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, do not use the Site or request our services.
These terms apply to all visitors, customers, and others who access or use the Site or engage TotalForm Rialto Concrete Masters for concrete contracting services.
TotalForm Rialto Concrete Masters is a licensed concrete contractor based in Rialto, CA. We provide concrete construction and related services for residential and commercial properties, including but not limited to: concrete driveways, patios, sidewalks, foundations, slabs, retaining walls, pool decks, floors, steps, footings, decorative and stamped concrete, and concrete cutting.
All work is performed in accordance with applicable California building codes, local ordinances, and permit requirements. Services are subject to availability, site conditions, and our capacity at the time of the request.
All estimates provided by TotalForm Rialto Concrete Masters are based on the information available at the time of the site visit and are valid for 30 days from the date issued unless otherwise stated in writing.
Written estimates represent the anticipated cost based on standard site conditions. If hidden conditions are discovered during work - such as unexpected underground obstructions, buried debris, or unstable soil conditions that were not visible during the initial site assessment - we will notify you before proceeding and provide a revised written estimate for the additional work.
Verbal estimates are not binding. Only written, signed estimates or contracts represent a commitment to price and scope of work.
Prices are subject to change based on material cost fluctuations outside our control. We will provide notice if any material price increases affect your estimate before work begins.
Once a project is scheduled, the start date is subject to weather conditions, material availability, and other factors outside our control. We will provide reasonable advance notice of any schedule change.
If you need to cancel or reschedule, please notify us at least 48 hours in advance of the scheduled start date. Cancellations with less than 48 hours notice may result in a cancellation fee to cover mobilization costs already incurred, including permit fees, material orders, or equipment staging.
We reserve the right to pause or delay work during extreme weather conditions, including temperatures above 105 degrees Fahrenheit, rain during active pours, or high-wind events that would compromise the quality of the finished work. We will communicate any such delay as soon as reasonably possible.
Payment terms are specified in the written contract or estimate for each project. Standard payment structure is as follows, unless otherwise agreed in writing:
We accept payment by check, cash, or electronic transfer as agreed at the time of contracting. Returned checks are subject to a $35 returned check fee.
Balances not paid within 30 days of the due date are subject to interest at a rate of 1.5% per month. We reserve the right to place a mechanic's lien on the property in accordance with California law if payment is not received.
Where required by local ordinance or code, TotalForm Rialto Concrete Masters will apply for and obtain the necessary permits before work begins. Permit fees are passed through to the customer at cost and will be itemized in the written estimate.
The customer is responsible for providing accurate information about property lines, underground utilities, HOA restrictions, and any easements that may affect the work. We are not responsible for delays or additional costs caused by information not disclosed to us before the project begins.
The customer must call 811 (Dig Safe / Underground Service Alert) or confirm that underground utilities have been marked before excavation work begins, unless we have agreed in writing to handle this step on your behalf.
TotalForm Rialto Concrete Masters warrants that all work will be performed in a workmanlike manner and in accordance with the specifications in the written contract. If defects in workmanship are identified within 1 year of project completion and are reported to us in writing, we will repair or correct the defective work at no additional charge.
This warranty does not cover:
Concrete is a natural material and minor surface variations, hairline cracks in control joints, and color variations are normal and are not considered defects.
To the fullest extent permitted by applicable law, TotalForm Rialto Concrete Masters's total liability to you for any claim arising out of or related to our services or these terms will not exceed the total amount paid to us for the specific project that gives rise to the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of use, loss of business, or loss of anticipated savings, even if we have been advised of the possibility of such damages.
We are not responsible for damage to underground utilities, irrigation systems, or other subsurface improvements that were not marked or disclosed to us before work began.
The content on this Site is provided for general informational purposes only. While we make reasonable efforts to keep the information current and accurate, we make no representations or warranties of any kind about the completeness, accuracy, or reliability of the information on this Site.
You may not use the Site in any way that violates applicable laws or regulations, interferes with the security or operation of the Site, or reproduces or distributes our content without written permission.
If a dispute arises between you and TotalForm Rialto Concrete Masters related to our services or these terms, we encourage you to contact us first to work toward a resolution. Most concerns can be resolved quickly through direct communication.
If a dispute cannot be resolved informally, you and TotalForm Rialto Concrete Masters agree to submit the dispute to binding arbitration administered by the American Arbitration Association under its Construction Industry Arbitration Rules, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.
You and TotalForm Rialto Concrete Masters each waive the right to participate in a class action or class-wide arbitration for any dispute covered by this section.
These Terms and Conditions are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal action not subject to arbitration under Section 10 will be brought exclusively in the state or federal courts located in San Bernardino County, California.
We may revise these Terms and Conditions at any time by updating this page and the effective date at the top. Continued use of the Site or our services after changes are posted constitutes acceptance of the updated terms. We recommend reviewing this page periodically.
